Villa Les Jardins Secrets — Sanary‑sur-Mer

1) Purpose
These terms and conditions govern the reservation and the furnished seasonal rental of the villa “Les Jardins Secrets” located in Sanary‑sur‑Mer, concluded between the owner and the customer.
2) Reservation — Contract formation
Reservation: only by phone at 06 51 42 72 47.
Deposit: 30% of the total amount upon reservation. Without receiving the deposit within 48 hours (working hours), the option is released.
Balance: The remaining balance is expected 10 days prior to arrival. If the balance is not paid by the due date, the reservation is cancelled at the expense of the customer.
3) Price — what's included/excluded
The rental price includes: the privatization of the lower part of the villa, the garden, the swimming pool, the equipment as well as the expenses of the villa. In addition, towels and sheets are provided.
Cleaning fees (200€) are to be paid directly to the concierge (arrival/departure cleaning).
Not included and due in addition: Tourist tax: according to the municipal scale in force per adult/night, collected on behalf of the community.
4) Security deposit (deposit)
Amount: [€] (check not cashed or borrowed CB/Vir bank transfer), delivered no later than when entering the premises.
Restitution: the day of departure if no damage. If necessary, the deposit will be retained in proportion to the damage. (damage, losses, excessive cleaning, overconsumption, non-compliance with regulations). If the deposit is insufficient, the customer undertakes to pay the additional amount on account within 7 days.
5) Payments — accepted methods
Accepted methods: check or bank transfer. No online payment. All international bank fees are the responsibility of the customer.
6) Capacity — use of the premises — rules of life
Maximum sleeping capacity: 8 people + 1 baby, strictly to be respected.
Use: Pets allowed (Warn in case of atypical animals). Tobacco/vaping: not allowed inside. Permanent supervision of children under the exclusive responsibility of the accompanying adults.
Nuisances: respect for the neighborhood and the condominium regulations where applicable; quiet time slots 22:00 — 08:00.
7) Cancellation — no show — early departure
By the customer: reimbursement of amounts paid except for the deposit, which is retained.
By the operator: in the event of a proven impossibility beyond its control (disaster, force majeure, administrative closure), the operator will reimburse you all the amounts collected.
8) Arrival — departure — inventory
Arrival: Define the time of arrival and departure directly with the concierge.
Inventory and inventory: carried out at the entrance and at the exit; any anomaly must be reported within 24 hours.
9) Cleaning — maintenance
The cleaning package (200€) covers a complete cleaning of the interior and exterior of the villa. The customer agrees to leave the kitchen tidy, dishes clean and trash cans emptied. Excessive cleaning, stubborn stains, textile damage: real billing, possible deduction from the deposit.
10) Responsible expenses and consumption
Charges are included for normal use. Obvious overconsumption (heating/air conditioning, doors, open windows, excessive watering, etc.): re-invoicing on supporting documents. Prohibition of recharging electric vehicles on non-dedicated domestic sockets; prior request required if terminal available.
11) Insurance — responsibilities
The customer certifies that they are covered by resort civil liability. The customer is responsible for damage caused by himself, the occupants and his service providers (e.g. caterer, photographer).
The operator cannot be held responsible for theft/loss of personal effects or for cuts in public services (water/electricity/internet) beyond his control.
12) Force majeure
No party is responsible for a breach due to an irresistible and unpredictable event that makes execution impossible (natural disaster, fire, administrative decision to close, etc.). The prevented party shall inform the other as soon as possible; application of art. 7 for the solutions proposed.
13) Personal data (RGPD)
Data controller: Elisabeth SAVARY.
Purposes: management of requests and reservations, accounting obligations, security of the premises.
Legal basis: contract execution, legitimate interests, legal obligations; consent for audience measurement if activated.

These terms and conditions are subject to French law. Any dispute relating to their interpretation or execution, in the absence of an amicable agreement, falls under the competent courts of the location of the building or the residence of the defendant.
